The “ambush” election rule, which
took efect three years ago under
the Obama administration, invades
workers’ privacy, unfairly burdens
employers, and should be rescinded
or modifed, according to SHRM written comments fled in April with the
National Labor Relations Board.
The regulation sped up the union
campaign period by limiting employers’ pre-election objections to who
may vote. It states that supervisors
may not vote in an election but isn’t
always clear on who qualifes as a
bona fde supervisor. The rule also
required employers to quickly fle a
position statement with the board.
The rule impedes employers’
ability to discuss the pros and cons
of union representation and violates
employees’ privacy by requiring the
involuntary disclosure of confdential
information, including workers’ e-mail
addresses, SHRM representatives
wrote. The comments were submitted
in response to the board’s December request for information on the
rule—an indication that the board is
considering withdrawing it.

FEDERAL HR AGENCY
Jef Pon, SHRM-SCP, formerly SHRM’s chief HR and strategy ofcer,
is the new director of the U.S. Ofce of Personnel Management (OPM).
His appointment to head the federal government’s HR agency was
confrmed by the U.S. Senate in March. He previously served in the
George W. Bush administration as chief human capital ofcer for the
U.S. Department of Energy and as a deputy director of e-government
at OPM during the launch of the USAJOBS careers site.
Pon’s confrmation comes as the Trump administration is set to unveil
its federal workforce agenda, including civil service reform proposals.
